In this document the expressions “Podere Cavàga”, “Cavàga”, “we”, “ci” and “nostro” refer to Podere della Cavaga S.r.l. Società Agricola.

2. Purpose of the Website

The Site presents and makes available information and services relating, among others, to:

Podere Cavàga and its agricultural and wine-growing activity;
wines, spirits and Cavàga Spirits products;
Cavàga Lab products;
food products and gift packages;
gift cards and vouchers;
stays and hospitality;
tastings and visits to the cellar;
catering and events;
picnic, tour and experience;
Cavàga Members initiatives;
commercial activities aimed at professionals and operators in the sector;
editorial content published in the blog section.

The information on the Site is of a general and descriptive nature.

The purchase of products or the booking of services is governed by the conditions shown during the checkout or booking procedure and by the information published in the relevant sections.

3. Technology platform

The online store is created and hosted through Shopify's technological infrastructure.

Shopify provides the technical tools necessary to operate the Site, catalog, cart, checkout and other features.

Contracts relating to the products and services offered directly by Podere Cavàga are concluded with:

Shopify is not the seller of Cavàga products and is not responsible for the execution of contracts concluded directly between Podere Cavàga and the customer.

Any services provided directly by Shopify, such as Shop or Shop Pay, may be subject to the terms of that provider.

4. Access to the Site

Access to the Site is normally free, without prejudice to:

the connection costs applied by the user's manager;
any reserved areas;
services that require registration, purchase or reservation;
the limitations provided for products or contents intended exclusively for adult users.

You are responsible for:

of your connection;
of the devices and programs used;
the protection of your credentials;
the correctness of the information communicated;
of using the Site in accordance with the law.

The information relating to wine, spirits, liqueurs and other alcoholic beverages is aimed at adults.

The sale and delivery of alcoholic products are reserved exclusively for people who have reached the age of eighteen.

“Podere Cavàga”, “Cavàga”, “Cavàga Spirits”, the related distinctive signs and product names may constitute registered trademarks, de facto trademarks, commercial names or other protected signs.

It is not permitted to use these signs in a manner suitable for:

generate confusion about the origin of products;
suggest non-existent business relationships;
imitate products or services;
compromise reputation, identity or brand positioning;
register domains, social accounts or similar names;
promote the products or services of others without authorization.

The names, brands and logos of third parties present on the Site belong to their respective owners.

10. Accuracy of information

Podere Cavàga takes care of the contents of the Site carefully and tries to keep them correct and updated.

However, it is not possible to guarantee that all information is, at all times:

complete;
free from clerical errors;
perfectly updated;
applicable to each individual situation;
immune to display glitches.

Errors or differences may occur regarding, for example:

24. Applicable law and jurisdiction

For disputes with a Consumer, the judge of the place of residence or domicile of the Consumer is competent, when located in Italian territory, without prejudice to what is mandatory by law.

The Consumer residing in another State of the European Union retains the mandatory protections provided for by the legislation applicable in his country of residence.

For disputes with companies, professionals or individuals who use the Site as part of their economic activity, the Court of Bergamo has exclusive jurisdiction, unless otherwise agreed in writing.
