In this document, the expressions “Podere Cavàga”, “Cavàga”, “we”, “ci” and “nostro” refer to Podere della Cavaga S.r.l. Società Agricola.

The Site uses the Shopify technological platform, which provides the infrastructure necessary to manage the online store. However, the contract for the sale of products or the provision of services is concluded directly between the customer and Podere Cavàga.

2. Scope of application

These Terms and Conditions govern:

  • access and use of the Site;
  • the online sale of wines, spirits, food products, Cavàga Lab products and other items;
  • the purchase of gift cards and gift vouchers;
  • the booking or purchase of stays, experiences, tastings, events and other services offered through the Site, when applicable.

By placing an order, creating an account, booking a service or using the Site, the customer declares to have read and accepted these Terms and Conditions and the Privacy Policy.

Any specific conditions indicated on the page of a product, a gift card, a stay, an experience or during the booking procedure constitute an integral part of the contract. In case of conflict, the specific conditions of the offer prevail over these Terms, without prejudice to what is mandatory by law.

“Consumer” means the natural person who acts for purposes unrelated to his entrepreneurial, commercial, artisanal or professional activity.

"Professional" means the person who purchases as part of his entrepreneurial, commercial, artisanal or professional activity.

3. Requirements for making purchases

To place an order on the Site you must:

  • be at least eighteen years old;
  • have the necessary legal capacity to conclude a contract;
  • provide correct, complete and up-to-date information;
  • use a payment method of which you are the legitimate owner or authorized user.

Sale of alcoholic products

The sale of wines, liqueurs, spirits and other alcoholic beverages is reserved exclusively for people who are at least eighteen years of age.

By placing an order containing alcoholic products, the customer declares under his own responsibility that he is of age.

Podere Cavàga and the appointed courier may request the presentation of a valid identity document at the time of purchase or delivery. Delivery may be refused if:

  • the recipient is not an adult;
  • it is not possible to verify its age;
  • the recipient appears manifestly impaired;
  • the delivery conflicts with obligations or prohibitions established by law.

Any failure to deliver caused by false declarations or the absence of an adult recipient may result in the cost of shipping, return and new delivery being charged, within the limits permitted by law.

4. Customer Account and Information

Creating an account is not necessarily required to place an order unless indicated during the purchase process.

The customer is responsible:

  • the correctness of the data communicated;
  • the confidentiality of one's credentials;
  • of the activities carried out through your account;
  • of updating contact, billing and shipping information.

The customer must promptly inform Podere Cavàga in the event of unauthorized use of the account or suspected violation of credentials.

Accounts may not be sold, assigned, transferred, or leased to any third party.

5. Products and information on the Site

Podere Cavàga undertakes to present the essential characteristics of the products and services as accurately as possible.

Images are for illustrative purposes. Colours, labels, packaging, years, formats or aesthetic elements may present slight differences due to:

  • to screen settings;
  • to artisanal production;
  • to the evolution of packaging;
  • to the natural characteristics of the product;
  • to the availability of the vintage or lot.

These differences do not affect the conformity of the product when they do not modify its essential characteristics.

For wines, spirits and food products, the customer is invited to carefully consult the product sheet, including information relating to:

  • ingredients;
  • allergens;
  • alcohol content;
  • format and quantity;
  • conservation mode;
  • provenance;
  • any warnings.

In case of allergies, intolerances or specific dietary needs relating to experiences, tastings, catering or stays, the customer must communicate them before purchasing or booking.

Podere Cavàga may update the descriptions, images and information on the Site to correct errors or reflect changes to the products, without affecting contracts already concluded.

6. Availability

The presence of a product on the Site does not guarantee that it will remain available until the order is completed.

In case of unavailability occurring after the order, Podere Cavàga will promptly inform the customer and will be able to:

  • propose an equivalent product, subject to customer acceptance;
  • agree to deferred delivery;
  • cancel the order totally or partially, refunding any amount already paid.

For agricultural, food, artisan products, limited editions and certain vintages, availability may be limited.

7. Purchase procedure and conclusion of the contract

The presentation of products and services on the Site constitutes an invitation to place an order and not a binding offer.

Before sending the order, the customer can check and correct:

  • the selected products or services;
  • the quantities;
  • the price;
  • delivery costs;
  • billing data;
  • the delivery address;
  • the payment method.

By sending the order, the customer formulates a purchase proposal and undertakes to pay the indicated amount.

After receiving the order, the customer will receive an electronic communication containing the summary of the purchase. The contract is considered concluded when Podere Cavàga sends the confirmation of acceptance or fulfillment of the order.

Podere Cavàga may refuse or cancel an order, even after automatic receipt of the same, in the following cases:

  • product unavailability;
  • failure to authorize payment;
  • incomplete, inaccurate or unverifiable data;
  • suspicion of fraud or illicit use;
  • manifest error in price or description;
  • failure to meet age requirements;
  • order intended for unauthorized resale;
  • inability to deliver.

In case of non-acceptance, any amounts already collected will be refunded without unjustified delay.

8. Prices

Unless otherwise indicated, all prices:

  • are expressed in euros;
  • include applicable VAT;
  • do not include shipping costs, unless expressly indicated as included.

Shipping costs and any additional costs are shown before the order is finally sent.

Podere Cavàga may change prices, promotions and commercial conditions at any time. The changes do not affect orders already concluded.

In the event of an obvious or recognizable error in the price, Podere Cavàga may contact the customer to propose confirmation of the order at the correct price or proceed with cancellation and refund.

Promotions, discount codes and offers:

  • are valid for the period indicated;
  • are not cumulative, unless otherwise indicated;
  • cannot be converted into cash;
  • may be subject to product, quantity or category limitations.

9. Payments

Available payment methods are indicated during checkout and may include payment cards, digital wallets, PayPal, Shop Pay, Klarna or other tools operated by third-party providers.

Payment information is processed by the respective providers under their terms and privacy policies. Podere Cavàga does not directly store full payment card details, except where necessary and permitted by law.

The customer guarantees:

  • that you are authorized to use the selected payment method;
  • that the information provided is correct;
  • that sufficient funds are available on the payment instrument.

Podere Cavàga may suspend order processing until payment has been confirmed.

Any invoice must be requested by correctly providing, before issuing the tax document, all the necessary data, including tax code, VAT number, recipient code or PEC address when applicable.

10. Shipping and delivery

The destinations served, costs and available delivery methods are indicated during checkout.

The delivery times communicated on the Site or in the confirmation email are indicative. Unless otherwise agreed, delivery to the Consumer will be made without unjustified delay and, in any case, within thirty days of the conclusion of the contract.

Podere Cavàga is not responsible for delays directly attributable to:

  • causes of force majeure;
  • strikes;
  • natural disasters;
  • authorities restrictions;
  • exceptional weather conditions;
  • incorrect or incomplete addresses provided by the customer;
  • repeated absence of the recipient;
  • customs procedures not dependent on Podere Cavàga.

The Consumer's rights provided by law in the event of non-delivery remain unaffected.

Passing of risk

For purchases made by a Consumer, the risk of loss or damage to the products passes to the customer only when the latter, or a third party designated by him other than the courier, physically takes possession of the goods.

The risk passes to the Consumer at the time of delivery to the carrier only when the carrier has been chosen independently by the Consumer and this choice has not been proposed by Podere Cavàga.

For purchases made by Professionals, the risk may pass at the time of delivery of the goods to the carrier, within the limits established by applicable legislation.

Package verification

Upon delivery, the customer is invited to check:

  • the integrity of the packaging;
  • the absence of obvious tampering;
  • the correspondence between the number of packages and the transport document.

In case of visible damage, it is advisable to accept the package with specific reservation or refuse delivery and document the damage with photographs.

Failure to make the reservation does not eliminate the rights recognized by law to the Consumer.

11. Damaged, incorrect or missing products

If a product is damaged, incorrect, incomplete or missing, the customer is invited to promptly contact accoglienza@cavaga.it, indicating:

  • order number;
  • problem description;
  • photographs of the external package;
  • photographs of the internal packaging;
  • product photographs;
  • possible courier label.

Podere Cavàga will evaluate the report and, when the problem is found to be well founded, will propose one of the remedies provided by law, including:

  • replacement;
  • new shipment;
  • integration of missing products;
  • price reduction;
  • refund.

The costs necessary to restore conformity of a defective or incorrect product are borne by Podere Cavàga.

12. Right of withdrawal

The Consumer who concludes a distance contract has the right to withdraw from the purchase, without having to provide any reason, within fourteen days.

For goods, the term starts from the day on which the Consumer, or a third party designated by him other than the courier, acquires physical possession:

  • of the asset;
  • of the last good, in case of multiple orders delivered separately;
  • of the last batch or piece, in case of split delivery.

To exercise the withdrawal, the Consumer must send, within the established deadline, an explicit declaration to:

Podere della Cavaga S.r.l. Società Agricola Via Gafforelli 1 24060 Foresto Sparso (BG)
Email: accoglienza@cavaga.it
PEC: poderecavagasrl@legalmail.it

The communication must contain at least:

  • name and surname;
  • order number;
  • affected products;
  • date of receipt;
  • unequivocal intention to withdraw;
  • address for any communications.

It is not mandatory to use a specific form.

13. Return of products

After communicating the withdrawal, the Consumer must return the products within fourteen days, unless Podere Cavàga has offered to collect them directly.

Products must be returned:

  • intact;
  • correctly protected and packaged;
  • complete with packaging, accessories and any related gifts;
  • without further manipulations than those necessary to establish its nature, characteristics and functioning.

The Consumer is solely responsible for the decrease in value resulting from handling other than that necessary to examine the product.

Unless Podere Cavàga has declared that it will bear it, the direct costs of the return following the withdrawal are borne by the Consumer.

The customer is encouraged to use a traceable shipping method and appropriate packaging, especially for bottles, glass and fragile products.

14. Refund in case of withdrawal

In case of valid withdrawal, Podere Cavàga will refund:

  • the price of the returned products;
  • the costs of standard delivery originally incurred by the Consumer.

Additional costs resulting from choosing a more expensive delivery method than the proposed standard delivery will not be reimbursed.

The refund will be made within fourteen days of the notice of withdrawal, using the same payment method used for the purchase, unless otherwise agreed.

Podere Cavàga may withhold the refund until receipt of the products or until the Consumer demonstrates that they have been sent back, whichever is earlier.

15. Exclusions from the right of withdrawal

The right of withdrawal is excluded in the cases provided for by law, including, by way of example:

  • goods made to measure or clearly personalized;
  • goods that are likely to deteriorate or expire rapidly;
  • sealed goods that are not suitable for return for reasons of hygiene or health protection and which have been opened after delivery;
  • products which, after delivery, are inseparably mixed with other goods;
  • fully executed services, when the execution has begun with the express consent of the Consumer and with the acceptance of the loss of the right of withdrawal;
  • supply of digital content not supplied on a material support, when execution has begun with the express consent of the Consumer and with acceptance of the loss of the right of withdrawal;
  • accommodation, restaurant, catering or leisure-related activities, when the contract provides for a specific date or period of performance.

Opening a normal external package does not automatically lead to the loss of the right of withdrawal. The exclusion is evaluated in relation to the nature of the product and the conditions established by law.

16. Stays, experiences, tastings and events

Reservations of rooms, stays, tastings, cellar visits, picnics, dinners, experiences, events and similar services are subject to:

  • to the specific conditions shown at the time of booking;
  • at the selected rate;
  • to the cancellation and modification conditions indicated in the offer;
  • to the times, access rules and any limitations communicated.

Fees may be refundable, partially refundable or non-refundable.

When the service provides for a specific date or period, the fourteen-day right of withdrawal provided for most distance contracts does not apply.

Changes in dates, participants or service are subject to availability and conditions of the offer purchased.

In case of delay, no-show or failure to use the service by the customer, the cancellation conditions indicated at the time of booking will apply.

Podere Cavàga may modify or cancel an experience for safety reasons, weather conditions, unexpected unavailability, force majeure or other causes that cannot reasonably be avoided. In such cases, where possible, the following will be proposed:

  • a new date;
  • an equivalent service;
  • a voucher;
  • reimbursement of the unused service.

17. Gift cards and gift vouchers

Gift cards are governed by the conditions indicated in the relevant product sheet and in the communication containing the code.

Unless otherwise indicated:

  • the gift card can be used for the specified product, stay or service;
  • must be used within the indicated validity date;
  • can only be used once, when applicable;
  • the reservation remains subject to availability;
  • cannot be converted into cash, except as required by law;
  • does not give the right to cash change, unless otherwise indicated;
  • cannot be used after expiration.

When the gift card is nominal, the transfer to third parties must be communicated in advance to Podere Cavàga.

The customer is responsible for safekeeping of the code. In case of loss, theft or unauthorized use, you must immediately inform Podere Cavàga. Any replacement can only take place when it is possible to verify that the code has not already been used.

Using a gift card to book a date-specific service is subject to the cancellation conditions applicable to that service.

18. Legal guarantee of conformity

Products sold to consumers are covered by the legal guarantee of conformity provided for by the Consumer Code.

Podere Cavàga is responsible for defects in conformity existing at the time of delivery and which appear within two years of delivery.

In the presence of a lack of conformity, the Consumer has the right, without charge, to the remedies provided by law, including:

  • repair, when applicable;
  • replacement;
  • proportional price reduction;
  • termination of the contract in permitted cases.

The requested remedy may be refused when it is impossible or involves disproportionate costs compared to the alternative remedy, taking into account the circumstances provided by law.

The following do not constitute defects of conformity:

  • normal deterioration resulting from use;
  • damage resulting from incorrect storage;
  • damage caused by the customer;
  • alterations resulting from failure to comply with conservation instructions;
  • natural or artisanal characteristics explicitly communicated;
  • variations accepted by the customer before purchase.

To benefit from the warranty, the customer must provide proof of purchase.

The legal guarantee is not limited by any additional commercial guarantees.

19. Product conservation

The customer is required to store wines, spirits and food products according to the instructions given:

  • on the packaging;
  • on the label;
  • in the product sheet;
  • in any attached communications.

Podere Cavàga is not liable for alterations caused by:

  • exposure to inappropriate temperatures;
  • direct sunlight;
  • humidity;
  • frost;
  • heat sources;
  • prolonged storage after opening;
  • failure to respect the expiry date or minimum shelf life;
  • improper handling after delivery.

  • that does not contain defamatory, discriminatory, unlawful or misleading material;

The customer grants Podere Cavàga a non-exclusive, free and limited license to use, reproduce and publish the content for the management, communication and promotion of products and services, in compliance with the legislation on the protection of personal data.

The presence of a link does not imply approval or warranty of the third party.

24. Privacy and cookies

The processing of personal data is governed by the Privacy Policy and the Cookie Policy published on the Site.

Shopify and other providers may process personal data in independent roles, as data processors or as other parties involved in providing services, as specified in their respective privacy policies.

The customer is invited to consult the Privacy Policy before using the Site or making a purchase.

25. Errors and information update

The Site may occasionally contain clerical errors, misprints, inaccuracies or outdated information relating, for example, to:

  • prices;
  • descriptions;
  • availability;
  • promotions;
  • ingredients;
  • characteristics;
  • shipping costs;
  • delivery times.

Podere Cavàga can correct such errors and update the information.

When the error affects an order already sent, the customer will be informed and will be able to confirm the order under the correct conditions or obtain a cancellation and refund.

26. Availability and operation of the Site

Podere Cavàga undertakes to keep the Site reasonably accessible and secure, but does not guarantee that:

  • the service is always available without interruptions;
  • each function is error-free;
  • the Site is compatible with any device or browser;
  • any malfunctions are resolved immediately.

The Site may be temporarily suspended for maintenance, updates, security or technical reasons.

These suspensions do not affect obligations deriving from contracts already concluded.

27. Limitation of Liability

Nothing in these Terms limits or excludes:

  • the mandatory rights of the Consumer;
  • liability for willful misconduct or gross negligence;
  • liability for death or personal injury;
  • liability for defective products;
  • any other liability that cannot be excluded by law.

To the extent permitted by law, Podere Cavàga is not responsible for indirect damages, loss of profit, loss of commercial opportunities or damages that are not reasonably foreseeable deriving from the professional use of the Site or the products.

Podere Cavàga is not responsible for damages resulting from:

  • improper use of products;

For Consumers, any possible limitation operates exclusively within the limits permitted by the Consumer Code and other applicable mandatory regulations.

  • introduction of new products or services;
  • organizational needs;

The updated version will be published on the Site with indication of the date of the last update.

Changes apply to orders and uses after publication. Contracts already concluded remain governed by the version accepted at the time of the order, except for changes imposed by law.

31. Severability and no waiver

If any provision of these Terms is declared void, ineffective or unenforceable, the remaining provisions will continue to have effect.

Failure by Podere Cavàga to exercise a right does not constitute a waiver thereof.

32. Applicable law and jurisdiction

These Terms and the contracts concluded through the Site are governed by Italian law.

For disputes with a Consumer, the judge of the place of residence or domicile of the Consumer has mandatory jurisdiction, when located in Italian territory.

The Consumer residing in another State of the European Union retains the mandatory protections recognized by the law of his country of residence, when applicable.

For disputes with professionals, companies or individuals who purchase for purposes related to their business, the Court of Bergamo has exclusive jurisdiction, unless otherwise agreed in writing.

The Consumer can also contact an alternative resolution body for consumer disputes, the so-called ADR body, registered in the lists kept by the competent Italian authorities.

The use of an ADR procedure does not limit the Consumer's right to appeal to the competent judge.

The former European ODR platform for online dispute resolution is no longer operational.
